Seller (CAD Designer) Terms & Conditions

1. Ownership and originality warranty

The Seller warrants that they are the original creator and lawful owner of every file uploaded, and that no file infringes any third party's copyright, design right, trademark, or other intellectual property right. This is a fundamental term of this agreement.

2. Indemnity

The Seller indemnifies and holds harmless Jeweltix, its directors, officers, employees and agents against any and all claims, demands, losses, damages, legal costs, and liabilities arising from any allegation that a Seller's uploaded file infringes third-party rights or is otherwise unlawful. This obligation survives termination of the Seller's account.

3. Licence to Jeweltix

By uploading, the Seller grants Jeweltix a non-exclusive, worldwide, royalty-free licence to host, store, display, generate reduced-resolution preview meshes of, market, and distribute the file to Buyers, and to transmit the .stl version to CAM Vendors solely for fulfilment of Buyer print jobs.

4. Mandatory file pairing

Where a Seller uploads a .3dm file, a corresponding .stl file must also be uploaded before the listing may be published. The Seller warrants that both files represent the same design.

5. Commission and settlement

Jeweltix retains a platform commission (percentage as notified on the platform, subject to change with reasonable notice) on each sale. Payout is calculated as: Buyer Payment − Platform Commission − actual payment gateway charges = Net Payout.

6. Payment hold

Seller earnings are held for 48 hours from the time of sale. If no dispute is raised within that period, funds are released to the Seller's withdrawable balance. If a dispute is raised, the payout for that transaction is frozen until the dispute is resolved, which may extend beyond 48 hours. The Seller expressly accepts this hold mechanism as a condition of selling on the platform.

7. Dispute outcomes

Jeweltix reserves the right, acting reasonably, to refund a Buyer in full or in part from held funds where a dispute is upheld. The Seller accepts Jeweltix's determination as final for platform purposes.

8. KYC obligation

Sellers must complete identity and bank verification (including PAN and bank/UPI details) before receiving any payout. Jeweltix may withhold payouts pending satisfactory verification, and may report suspicious activity to relevant authorities.

9. Content standards

Sellers may not upload files that are stolen, copied, misrepresented, malicious, or that infringe applicable law. Jeweltix may remove listings and suspend accounts at its discretion.

10. Independent status

Sellers are independent third parties. Nothing in this agreement creates employment, partnership, agency, or joint venture with Jeweltix.

11. Takedown and repeat infringement

Jeweltix operates a notice-and-takedown process. Sellers subject to repeated valid infringement complaints will have their accounts permanently terminated, and held earnings may be withheld pending resolution of outstanding claims.

12. Anti-circumvention

Sellers must not solicit Buyers introduced through Jeweltix to transact off-platform.


Common Clauses

Governing law

These Terms are governed by and construed in accordance with the laws of India.

Jurisdiction

The parties irrevocably agree that the courts at Pune, Maharashtra, India shall have exclusive jurisdiction over any dispute, claim, or matter arising out of or in connection with these Terms or use of the platform.

Dispute resolution

The parties shall first attempt resolution through Jeweltix's internal grievance mechanism. Any dispute not so resolved shall be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Pune, Maharashtra, and proceedings shall be conducted in English. The arbitral award shall be final and binding.

Force majeure

Neither party is liable for failure to perform due to events beyond reasonable control, including natural disasters, war, civil unrest, government action, pandemics, power or internet failure, or third-party service outages.

Amendment

Jeweltix may amend these Terms at any time. Material changes will be notified at least 15 days in advance by email and in-app notice. Continued use after the effective date constitutes acceptance. Users who do not accept may close their account and withdraw cleared balances.

Severability

If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect.

Entire agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between the parties regarding use of the platform.

Suspension and termination

Jeweltix reserves the right to suspend or terminate any account for breach of these Terms, suspected fraud, or unlawful activity, at its sole discretion.

In accordance with the Information Technology Act, 2000 and rules thereunder, the Grievance Officer for Jeweltix is:
