1. Nature of the platform
Jeweltix is an online marketplace for digital jewellery CAD design files only. Jeweltix does not manufacture, sell, or supply physical jewellery, precious metals, or gemstones. All purchases on this platform are of digital files.
2. Intermediary status
Jeweltix acts solely as an intermediary connecting Buyers with independent third-party Sellers and CAM Vendors. Jeweltix is not the author, owner, manufacturer, or supplier of any design file or printed output. Contracts for design files are between Buyer and Seller. Contracts for printing services are between Buyer and CAM Vendor.
3. Licence granted, not ownership
Purchase grants the Buyer a limited, non-exclusive, non-transferable licence to use the file for the Buyer's own production purposes. Buyers may not resell, redistribute, sublicense, share, or upload purchased files to any other platform, nor claim authorship of the design. Breach may result in account termination and legal action by the Seller and/or Jeweltix.
4. File formats
.3dm files are editable; .stl files are non-editable print-ready meshes. Buyers are responsible for confirming format suitability before purchase. Jeweltix does not warrant that any file is suitable for any particular manufacturing process, machine, or metal.
5. Payment
All payments are processed through a third-party payment gateway. Jeweltix does not store card details.
6. Refunds and dispute window
Digital files, once downloaded, are non-refundable except where a dispute is raised and upheld under this clause. Buyers may raise a dispute within 48 hours of purchase. Valid grounds include corrupt files, wrong file delivered, or material mismatch with the listing description. Dissatisfaction with aesthetic or design preference is not a valid ground. Refund eligibility is determined by Jeweltix acting reasonably, and its determination is final for platform purposes.
7. Print jobs (CAM Vendor services)
Where a Buyer engages a CAM Vendor through the platform, Jeweltix's role is limited to matching, file transmission, payment facilitation, and status tracking. Jeweltix does not perform, supervise, inspect, guarantee, or warrant the printing work, print quality, materials, turnaround time, or delivery. Print pricing is set solely by the CAM Vendor. Jeweltix is not liable for defective prints, delays, damage in transit, or non-delivery, though it will facilitate dispute resolution.
8. Sharing of Buyer contact data
Buyers acknowledge and consent that, upon issuing a print job, their name, mobile number, email address, and (where delivery is selected) delivery address will be shared with the selected CAM Vendor solely to enable fulfilment.
9. Limitation of liability
To the maximum extent permitted by law, Jeweltix's total aggregate liability arising out of or in connection with any transaction shall not exceed the amount actually paid by the Buyer for that specific transaction. Jeweltix shall not be liable for indirect, incidental, consequential, special, or business-loss damages, including without limitation production losses, wasted materials, casting failures, machine downtime, or lost profits.
10. No manufacturing warranty
Jeweltix makes no representation or warranty that any file will cast, print, or manufacture successfully. Manufacturing outcomes depend on machinery, materials, settings, operator skill, and processes entirely outside Jeweltix's control.
11. Prohibited conduct
Buyers may not circumvent the platform to transact directly with Sellers or CAM Vendors first introduced through Jeweltix, reverse-engineer platform security, scrape listings, extract or misuse preview meshes, or use automated tools to access the platform.
Common Clauses
Governing law
These Terms are governed by and construed in accordance with the laws of India.
Jurisdiction
The parties irrevocably agree that the courts at Pune, Maharashtra, India shall have exclusive jurisdiction over any dispute, claim, or matter arising out of or in connection with these Terms or use of the platform.
Dispute resolution
The parties shall first attempt resolution through Jeweltix's internal grievance mechanism. Any dispute not so resolved shall be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Pune, Maharashtra, and proceedings shall be conducted in English. The arbitral award shall be final and binding.
Force majeure
Neither party is liable for failure to perform due to events beyond reasonable control, including natural disasters, war, civil unrest, government action, pandemics, power or internet failure, or third-party service outages.
Amendment
Jeweltix may amend these Terms at any time. Material changes will be notified at least 15 days in advance by email and in-app notice. Continued use after the effective date constitutes acceptance. Users who do not accept may close their account and withdraw cleared balances.
Severability
If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect.
Entire agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between the parties regarding use of the platform.
Suspension and termination
Jeweltix reserves the right to suspend or terminate any account for breach of these Terms, suspected fraud, or unlawful activity, at its sole discretion.
